  • EU Parliament President Accepts Disability Rights Demands

    This week (14. – 17. Sep), 440 people from 21 European countries met in Strasbourg for the Freedom Drive. The group included disabled people with their personal assistants. The common cause being Independent Living: deinstitutionalisation, the right to personal assistance and the ratification of the UN Convention on the Rights of Persons with Disability

    The UN Convention on the Rights of People with Disabilities must become a reality!

    FOR THE RESPECT OF HUMAN RIGHTS!
    FOR IMPLEMENTATION OF EQUAL OPPORTUNITIES!
    FOR ELIMINATION OF DISCRIMINATION!

    On Tuesday 25.5.2010 at 11 a.m. we will gather in Argentinski Park in the centre of Ljubljana. At 12 a.m. we will begin to march toward the Office of the President of the Republic and toward the National Assembly.

    WE DEMAND

    Inclusive educational system! It represents the implementation of social justice because it creates a society of equal opportunities and equality. Disabled children and adolescents should be integrated into mainstream schools. State shouldn’t be building special schools and institutions for them. Pupils and students must have the right and opportunity to be included into the regular educational system. Even though we have legislation which should provide for equal opportunities, in practice there are still complications with inclusion of children with special needs.

    Employment in regular work places! It should be systematically encouraged. Even though we have Law on the Rehabilitation and Employment of disabled persons, many services which are enshrined in it, are not carried out. For example in five years not even one PA placement on the workplace was realised. This Law also excludes all those who have the disability status under the Law on Social care of mentally and physically disabled.

    Deinstitutionalization – Closing down the institutions for persons with disabilities! Segregation of individuals in the institutions is a violation of human rights itself. It is necessary that state institutions and service providers understand the need to ensure diversion of financial resources away from institutional care towards community services to enable Independent living for disabled. This is the only way which provides an individual with equal opportunities and participation.

    Personal assistance according to ENIL principles! Government proposal does not give a clear definition of what constitutes the right to PA, also it doesn’t arise out of the concept of International movement on Independent living and it is based on models of care, that is happening because the Law on PA is based on the Law on long – term care which is aimed to older populations. We demand strict adherence of the Convention on the Rights of People with Disabilities, especially to article 19 which talks about the right to PA. The proposal separates individuals according to their diagnosis, in article 6 of the Law on PA, there is a condition which excludes all persons who are unable to plan their own daily activities; that represents exclusion of persons that are deprived of their capacity to exercise or they have signs of mental impairments. This represents a serious form of discrimination and also an attempt to exclude a large group of people that are in need of PA. The assessment of needs must be carried out by independent bodies as a financial co-source for services should also include funding from the Foundation of Disability and Humanitarian organizations.

    ACCESSIBILITY!
    Architectural accessibility – many public buildings are still inaccessible to disabled persons who use wheelchairs.
    Information accessibility – all important documents should be issued in the form that is accessible to sensory and intellectually disabled persons. National TV station should also introduce subtitling and sign language translation, at least for all shows of their own production. Web sites of public institutions should also be consistent with standards of accessibility for sensory disabled.
    Public transport accessibility – disabled persons have the right to use public transport. All public transport should be accessible to persons that are using wheelchairs. Stations, buses and trains should be equipped with voice information.

    Accessibility On May 25, at 11.00 o’clock we have gathered in the centre of Ljubljana. After a short programme and presentation of the demands to the participants we began with a loud and colourful march through the centre of the city and towards the office of the President of the Republic.

    ENIL REMEMBERS THE 4th OF APRIL INTERNATIONAL DAY OF MINE AWARNESS

    Accessibility The General Assembly of the United Nations designated April 4th as the International day of Mine Awareness. The day is designated to raise awareness about the land mines and the progress of the process of mine destruction. According to the UN report, more than 2000 individuals are killed by land mines every month and there are even more that suffer lasting effects. Among the victims there was 80 percent of civilians and 25 percent of them were children.

    Slovenia is actively engaged in assistance to mine victims. Rehabilitation in Slovenia takes place in the Institute for Rehabilitation. Cruel events that led to war in the South East Europe set bound to the Institute to continue with all efforts to limit war implications and consequences of it. In the context of all this there have been a number of activities organized. Until now 911 individuals were rehabilitated by the Institute also including children from Gaza Strip. Rehabilitation includes medical and psychosocial rehabilitation services, vocational rehabilitation, and production of prostheses and educational programs for doctors coming from mine affected countries.

    International community is also faced with the problem of explosive remnants of war, which also pose a significant threat to the security. In 1998, Slovenian government established International Trust Fund (ITF) and with that the ITF began to participate in the aftermath of conflict in the Balkans.

    ENIL is aware of the terrible humanitarian consequences of the ‘secret killer’ and therefore agrees with all international efforts to leave to the next generations a safer world without mines.


    A BATTLE THAT WE CAN WIN: DISABILITY PACT TO SAVE EUROPE 2020

    Internatioonal coop. 21 March 2010 /// The European Disability Forum (EDF), the voice of 65 million European citizens with disabilities, met in Thessaloniki, Greece and adopted the Disability Pact declaration.

    This is to ensure that the strategy EUROPE 2020, to be embraced by the European Council next week, will include the Disability Pact as one of its flagship priorities.

    Yannis Vardakastanis, President of EDF, stressed that: “The Disability Pact is the best policy instrument to ensure real mainstreaming of disability in the European Union by promoting the rights of persons with disabilities and by developing a strong agenda engaging both the EU Institutions and Member States”.

    Such a political context implies a real need for coordinated actions. It is crucial for the European Commission to synchronize its disability strategy with Member States: the European Disability Pact is therefore the essential tool.

    EDF President Yannis Vardakastanis stressed that “The European Disability Pact will be a driving force allowing the EU and its members States (leading to a barrier free ...) to sail off to a barrier free Europe for persons with disabilities”. Through this Pact, Europe 2020 strategy will give new impetus to the social inclusion of persons with disabilities, recognizing disability as a cross cutting issue.

    The Pact will cover employment, social protection, education, growth and competitiveness, e-inclusion policies and research.

    In the Disability Pact declaration, the leaders of the disability movement call on the European Council:
    • to adopt the European Disability Pact which commits EU Member States and EU institutions alike to work towards well-defined targets for the systematic improvement of living conditions of persons with disabilities in Europe.
    • to include and integrate the European Disability Pact in Europe 2020, the strategic framework for future economic and social policies of the EU. Realising the ambitious targets about higher employment and a work force with better skills presupposes that millions of disadvantaged persons with disabilities are given a fair chance to be part of education and working life.
    • to adopt the European Disability Pact as one of the flagship initiative of Europe 2020, that will bring about the necessary coordination and coherence of policies. The Disability Pact will ensure that direct policy initiatives benefitting persons with disabilities are being taken, but also that the needs of persons with disabilities are sufficiently mainstreamed in other strands of Europe 2020.

    Addressing the leaders of the disability movement, Markos Bolaris, Greek Deputy Minister of Financial Affairs and Theodora Tzakri, Deputy Minister for the Interior Affairs, assured that despite the financial crisis, Greece will strive to tackle discrimination of persons with disabilities.

    Background: Why is the Disability Pact necessary?

    The Disability Pact for 2010 to 2020 is a coordinated and sustainable disability policy framework at European and national level, with clear and long-term direction and cooperation between Member States and the European Union. At the moment, there is no long-term EU agenda on disability that involves a clear joint commitment from the Institutions and its Member States. The 27 member states are developing 27 different national disability action plans.

    Coordination between the European and national actions, and clear and measurable objectives linked to the EU strategy for growth and jobs is the road to a barrier-free Europe. Everyone will benefit from its adoption: the member States, the European Commission and the 65 million persons with disabilities.

    PROGRAMME OF PAID TRAINEERSHIPS FOR PEOPLE WITH DISABILITIES

    Internatioonal coop. The European Parliament is offering paid traineeships to persons with disabilities, as a positive action measure aimed at facilitating the integration of disabled people in the workplace.

    These traineeships are open both to graduates of universities or equivalent institutions and to people whose qualifications are below university level. The main purpose of this programme is to offer a number of people with disabilities a meaningful and valuable work experience, and an opportunity to familiarise themselves with the activities of the European Parliament.

    Paid traineeships are awarded for a period of five months which cannot be extended. Please note that traineeships do not give trainees the right to future employment in the European Parliament.

    Starting dates and application periods
    Beginning of traineeship Application period
    1 March 15 August – 15 October (midnight)
    1 October 15 March – 15 May (midnight)

    We advise you not to wait until the last day to apply, to prevent the system from becoming overloaded because there are a large number of applications.

    Applicants for this programme must:
    be nationals of a Member State of the EU or of an applicant country;
    be over 18 years of age on the traineeship starting date;
    have a thorough knowledge of one of the official languages of the EU and a good knowledge of a second;
    not have been awarded any other paid traineeship, or have been in paid employment for more than four consecutive weeks, with a European institution or a Member or political group of the European Parliament;
    be able to certify that they have a disability/ies (medical certificate or disability certificate/card issued by a national authority).

    If you are selected, the following documents will be requested:
    - a duly signed application form (print your application after validation);
    - a copy of your passport or identity card;
    - a copy of your most recent study certificate, or university diploma(s), if applicable;
    - a signed written reference from a lecturer at a university or other educational institution or a letter from a professional person who is able to give an objective assessment of your abilities;
    - a document certifying your disability/ies, recognised in a Member State of the European Union or in an applicant country.
    Please note that it is not necessary to send these documents at the time of application.

    Supporting documents will be requested if you are offered a traineeship. If you are offered a traineeship, you will not be admitted unless you provide the full set of documents mentioned above.

    If you fulfil the conditions for admission, please complete the online application form, which you can prepare by using the sample form, which however only provides the main fields to be filled in the online application form. Please note that if you leave your online application form inactive for 30 minutes, the data you have entered will be lost. The application is completed and submitted in a single operation and cannot be changed afterwards. It is very important that you print your application form after validating it because if you are selected, the paper version of your application form, duly signed, will be requested, together with the supporting documentation.

    Once you have confirmed your online application, you will be allocated a number. Please indicate this application number in all correspondence concerning the traineeship.

    Dear Mr. Dodik,

    I am contacting you on behalf of ENIL, the European Network on Independent Living, we are aware of the Hunger Strike that is being carried out in Banjaluka, the second largest city in Bosnia and Herzegovina.

    Employees in the Institute for Dystrophics are on hunger strike, following a row over job losses. Employees blame management for the situation. The Institute faces bankruptcy and residents are threatened that without jobs they will stay without a place to live and might be put in institutions.

    The 23 severely disabled persons will not give up their demands for the return of their colleagues to work and the involvement of two disabled persons in a bankruptcy group who will protect the rights of disabled workers.
    Most of the strikers are already in bad health because of Muscular Dystrophy but now they are experiencing disturbed blood pressure and dizziness.

    Institute workers blame management for the economic situation and for putting obstacles in the way of entrepreneurship for persons with disability.

    The Institute opened in 1989 as a unique example of the social model of disability and inclusive practice. Persons with Muscular Dystrophy, who were alone or lived in inaccessible places or with older parents, came to this Institute for accommodation and employment. For many years they had an independent life style, taking control over their lives and earning money for living as any other member of the community.
    It will be a real shame if the Institute will change its concept and become closed for the employment and independent living of people with severe disabilities. The government of Republika Srpska should find the way the overcome financial problems and enable disabled people to achieve their basic human rights.
    ENIL urges you to take a stand and help these people to solve their problem and we thank you for any support you will be able provide.

    YHD – Association for Theory and Culture of Handicap from Slovenia also a member of ENIL1 (European Network on Independent Living) gives all support to friends that have decided to go on hunger strike to fight for their right to be employed and their right to work, which gives them an opportunity for a decent standard of living. Most of the strikers are already in bad health because of Muscular Dystrophy and they all suffered a lot during the war, that is why their will to live and work is even more important and worthy of admiration and respect. They are even setting an example to all other citizens and should be shown as an example of good practice through out the world.

    Residents of the Institution have no other housing options or alternatives for life and work of residents, so any act that goes towards the closure of the institution and their jobs is unacceptable. Especially in accordance with the UN Convention on the rights of people with disabilities2 in particular articles 5. 15., 16., 17., 19., 25., 27.

    We urge you to tackle the given situation immediately and provide all relevant conditions for life and work of the residents of the Institution. We have also informed the MEP’s from Slovenia about this situation and asked them for help and intervention.


    In hope and desire, that the promises that were made to the residents in 2009 will be met.

    BANJALUKA – Employees in Institute for Dystrophics in Republic Srpska continue their hunger strike, second day in a row after the job cancellation received by temporary director. They blame management for that bad situation.

    Drago Novakovic, resident’s representative told us that 23 severe disabled persons would not give up of their demands: all their colleagues that received job cancellation should be return to work, two disabled persons should be involved in bankruptcy group who will deal with the future issues and protect the rights of disabled workers.
    Worker’s representatives showed yesterday the video from the last year, where Mr. Milorad Dodik, Prime Minister of Srpska Republic, promise them to help and solve this problem.
    "We do not want to go out and disturb our citizens falling out of our wheelchairs. If we start to fall we will do it here in our Institute", said Novakovic.
    Most of the strikers are in really bad health condition due to Muscular Dystrophy and ER already visited them because of disturbed blood pressure and dizziness.
    For the economically bad situation in Institute workers blame management that let for years the devastation of unique entrepreneurship of persons with disability.
    "No matter of our education, we could not be in managerial position. Technical director came here 8 years ago because the director was his son in law", workers continue.
    According to them there are three more persons, beside bankruptcy director, Head of law issues, Technical director and Head of commercial issues and all of them were involved in process of bacruptcy.
    Some of them terrorized and humiliated disabled workers, Neki od ovih rukovodećih, tvrde radnici, provode strahovladu u Zavodu maltretirajući i omalova˛avajući radnike invalide.
    Radovan Radulj, bankruptcy director did not want to comment anything.
